Pursuant to Article 3 of Law No. 6563 on the Regulation of Electronic Commerce, this information is kept accessible within the Application at all times (see Document 16 — Business Identification, Contact, Complaints and Dispute Resolution).
The Business provides, through the Application, a service of hourly, private access to a physical facility: using the credit they have purchased, the Member gains access to a private training area reserved for them (alone, or together with at most two group members) at a specific facility, at a specific time.
No digital content is sold through the Application. A Credit is not an in-game currency, token, or digital product; it is solely the prepaid equivalent of the use of a physical facility.
The Business also functions as an intermediary platform enabling independent trainers to give one-on-one lessons to Members (see Article 16).
A Credit is a prepaid facility-use unit that may only be used within the Business's own service network. A Credit:
The limitations in this article do not eliminate the right of withdrawal and refund provisions set out in Document 5, Article 5 and Document 13, Article 11.
How many Credits a one-hour Session corresponds to varies by facility and by the Session's time band; the current fee is always clearly shown in the Application before the reservation is created, and the reservation is only created after the Member has seen this fee. The time bands and fees in effect as of the publication date appear in Document 13, Annex 1; separate bands may apply for weekdays and weekends.
Credits are preserved as the number of credits purchased; however, how many hours of future use credits not yet tied to a reservation will correspond to is determined by the current tariff shown in the Application at the moment of reservation. The credit fee of a reservation that has already been created and whose fee has been locked in/paid cannot subsequently be increased to the Member's detriment. Tariff changes apply prospectively and are announced through the Application before they take effect (see Document 13, Article 6 for detail).
The following sanctions are applied automatically by the system according to the nature of the violation. Full detail is in Document 13; the sanctions are summarized numerically below:
| Violation | Consequence |
|---|---|
| Cancellation more than 12 hours before the Session start | Credit is fully refunded |
| Cancellation less than 12 hours before the Session start | The locked-in credit is not refunded |
| No-show | The locked-in credit is lost and an additional 50-credit penalty is applied |
| Overstay (late exit) | The locked-in credit is lost and an additional 30-credit fee is charged |
| A total of 2 violations (of any type) | The account is suspended for 7 days |
| The 3rd and 4th violations, in total | Only the credit penalty is applied; since the suspension period is already ongoing or completed, no additional sanction is added |
| A total of 5 violations (of any type) | The account is permanently closed; the remaining credits are forfeited without refund |
Because some sanctions are applied automatically by the system, the Member may object to these decisions through the channel described in Document 16; the objection is reviewed by a human being.
The credits of a Member whose account is suspended (temporarily) are preserved untouched; once the suspension period ends, the credits again become usable as-is.
The remaining credits of a Member who is permanently banned are forfeited without refund, as stated in Article 8. This is a sanction applied by the Business against a rule violation; it does not apply where the Business terminates unilaterally and without cause (see Article 22).
Pursuant to Article 115 of the Turkish Code of Obligations, agreements that prospectively eliminate a debtor's liability arising from intent or gross fault are absolutely void. Accordingly, the Business may reasonably limit its liability arising from slight fault; however, it is fully liable for damages arising from its intent or gross negligence. The Business undertakes to fulfill its obligations to maintain, inspect, and secure the facility.
In the event of a temporary closure of the facility, a smart lock malfunction, a power or internet outage, or system maintenance, a credit refund or equivalent compensation (a right to re-book) is provided for the affected reservations. Force majeure events (earthquake, fire, an official authority's decision, etc.) do not eliminate this obligation; they only reasonably postpone the time of performance.
In the event a gym is permanently closed or relocated, future reservations tied to that gym are cancelled and the corresponding credit is refunded in full; other unused credits (if valid across multiple gyms) are unaffected.
Lockers and personal belongings are the Member's own responsibility; it is advisable not to bring valuables to the facility. Items left behind are kept by the Business for a reasonable period and may be requested through the support channel.
Equipment must be used only for its intended purpose. Faulty equipment must be reported immediately through the support channel. Damage caused intentionally or through negligence is compensated by the Member based on the actual amount of the damage.
Every Group Member who joins a Group Reservation does so with their own account, pays their own share, and is deemed to have accepted this Agreement in their own name — the Member who starts the group is not responsible for the conduct of, or any damage caused by, the other members; each Member is responsible only for their own conduct. Payment timing, the request window, and refund rules are set out in Document 13, Article 7.2; the joining screen shows the gym/date/time/amount information before payment.
The Business acts as an intermediary service provider between the Member and independent trainers. Training services are provided by the independent trainer under their own responsibility; the trainer sets the price, and the Business cannot change it. The detailed framework relating to trainers is set out in Document 10 — Trainer Intermediation and Service Agreement.
The participation rules and liability framework for events within the Application are presented separately — see Document 8 — Event Participation Rules and Liability Statement.
The following conduct is prohibited both inside the facility and within the Application: letting someone else use the account; sharing the QR code or PIN; bringing in a stranger outside a group reservation; intentionally damaging equipment; harassment, threats, or disturbing behavior directed at other Members in the unstaffed facility; moving communication that should be conducted through the Application outside the platform; and submitting a false document or false information. If such conduct is detected, the sanctions regime in Article 8 applies.
The Member is granted a personal, non-transferable, non-exclusive license to use the Application. Reverse engineering, copying, or modifying the Application is prohibited. Content the Member produces within the Application (messages, reviews, photos) grants the Business a limited license to use it solely for the purpose of providing the service; ownership of the content remains with the Member.
In-app notification and delivery to the Member's registered email address are deemed valid notice. The Member is obliged to keep their contact information up to date (see Article 4.5).
Amendments to the Agreement are notified through the Application before they take effect. If the Member does not accept the new version, they may terminate the Agreement and request a refund of their unused credits (see Article 22). This article may not be interpreted as granting the Business an unlimited and unilateral power of amendment; amendments must be reasonable and notified in advance.
The Member may close their account at any time; the fate of any unused credits is set out in Document 14 — Account and Data Deletion Policy. Other than the violation cases defined in Articles 8-9, the Business does not resort to unilateral termination without just cause.
If the Business assigns this Agreement to another legal entity, the Member's rights arising from this Agreement (including unused credits) are preserved and recognized by the assignee.
Turkish law applies to disputes arising from this Agreement. In disputes arising from consumer transactions, Consumer Arbitration Committees have jurisdiction within the monetary limits, and Consumer Courts have jurisdiction above them; applying to a mediator before filing a lawsuit in the Consumer Court is a condition for filing suit (Law No. 6502, Art. 73/A). In consumer disputes, the Member's place of residence also has jurisdiction; a provision fixing jurisdiction to a single province is not valid under this Agreement.
The version of this Agreement approved by the Member is sent, together with the version in effect at the time of approval, to the Member's registered email address by email, which constitutes a durable medium. The Member may at any time access the past versions of this Agreement and their approval record within the Application, from the Profile › My Consents screen.
If this Agreement contains a provision previously altered to the Member's detriment, that provision is invalid and the mandatory provision of the applicable legislation applies in its place. Ambiguous provisions of the Agreement are interpreted in favor of the Member.
