Distance Sales
This Pre-Contractual Information Form and Distance Sales Agreement ("Agreement") is concluded electronically, through the Solos Gym mobile application, on the order date, between Solos Gym (the "Seller") and the consumer whose identity information appears below ("Buyer").
The subject matter of the Agreement is the determination of the parties' rights and obligations, pursuant to the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the credit package whose characteristics and sale price the Buyer ordered through the Application. Pursuant to Article 5/2 of the Regulation on Distance Contracts, the pre-contractual information in Article 2 below is an integral part of this Agreement.

Following your approval, the version of this Agreement generated specifically for this order is sent to your registered email address by email, which constitutes a durable medium.
| Field | Value |
|---|---|
| Credit equivalent of a one-hour session | Varies by facility and by time band (weekday/weekend) — current tariff in Document 13, Annex 1 |
| Additional charges | None — no additional charge such as card commission, shipping, or service fee applies beyond the amount above. |
Credits are not money; they are solely a prepaid usage unit that can be used only at Solos Gym's own facilities — see Document 1, Article 5 for detail.
Payment is collected by credit/debit card through PayTR's secure payment page. Your card details are not stored on Solos Gym systems; they are transmitted directly to PayTR (see Article 9).
The moment payment is confirmed, the purchased credits are added to the Buyer's account and become ready for use; this moment is when performance begins.
If payment fails, no credit is added, no amount is charged to the Buyer, and any associated reservation hold period ends in its normal course.
Which of the two situations below applies to your order is clearly indicated in the order summary (Article 3, "whether the order is tied to a reservation").
Because no service has yet been performed at the moment of payment, you may withdraw from this Agreement within fourteen (14) days of the purchase date, without stating any reason and without paying any penalty. In the event of withdrawal, the full amount you paid is refunded for entirely unused credits; if partially used, the equivalent of the unused portion is refunded, calculated using the formula in Article 7.
This purchase is intended to immediately confirm a reservation, at a specific facility and on a specific date and time, that you selected in advance — performance of the service (the reserving of that hour specifically for you) begins immediately upon confirmation of payment. The Regulation on Distance Contracts lists services relating to leisure activities that must be performed on a specific date or period as among the exceptions to the right of withdrawal; this type of purchase falls within that exception. You still have the right to cancel the reservation — its conditions are set out in Document 13, Article 8 (full refund on cancellation more than 12 hours in advance).
Notice of withdrawal may be given through the in-app support screen or in writing to info@solosgym.com. A sample withdrawal form is provided in Document 13, Annex 2; its use is not mandatory. The refund is made within fourteen days of receipt of the notice, to the instrument used for payment.
In the event of termination of the Agreement (including exercise of the right of withdrawal), the Seller is obliged to refund all payments collected within fourteen days of the date the notice of termination reaches it.
On the payment screen, after this Agreement is accepted, the Buyer is presented with the following declaration as a separate box, and the order is completed only if it is checked:
"I request that performance of the service begin before the fourteen-day withdrawal period expires; I know that my right of withdrawal will end to the extent I begin using my credits."
An order cannot be created without this declaration being given — since the credit package is added to the Buyer's account and becomes usable the moment it is purchased, performance in fact begins at the moment of approval; this declaration is the clear and informed acknowledgment of that fact.
If the right of withdrawal is exercised for a partially used credit purchase, the refund amount is calculated using the formula in Document 13, Article 11.4:
Refund amount = Amount paid × (Unused credits ÷ Total credits added by the purchase)
The refund is made to the same payment instrument, within fourteen days.
In the event of a dispute, recourse may be had, within the current monetary limits announced annually by the Ministry of Trade, to the Consumer Arbitration Committee in the consumer's place of residence or in the place where the consumer transaction took place; for disputes above that limit, to the Consumer Court. Applying to a mediator before filing a lawsuit in the Consumer Court is a condition for filing suit (Law No. 6502, Art. 73/A). Contact channels are set out in Document 16.
The payment transaction is carried out through PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş.; the card number, expiry date, and security code never reach Solos Gym's servers — they are transmitted directly to PayTR's PCI-DSS compliant systems. See Document 11, Article 4 for detail.
If the Buyer files a payment dispute (chargeback) with their bank or card issuer, the credits added by the disputed transaction may be closed to use until the dispute is resolved. If the dispute is resolved in the Seller's favor, the credits are reopened; if resolved in the Buyer's favor, the credits are deducted from the account. See Document 13, Article 14 for detail.
After your payment is confirmed, your e-Arşiv or e-Fatura document is issued according to the recipient's taxpayer status and sent to your registered email address. The access link from the document provider also appears in your account activity.
If the Seller fails to fulfill its refund obligation within the prescribed period, the Buyer may claim default interest under the general provisions.
The Buyer may terminate the Agreement at any time, within the withdrawal period and by the procedure in Article 5. The Seller may terminate the Agreement if the Buyer breaches it (for example, by unjustly exercising a payment dispute); in that case, the sanctions regime in Document 1, Article 8 may also apply.
In disputes arising from this Agreement, the Consumer Arbitration Committee has jurisdiction within the current monetary limits, and the Consumer Court has jurisdiction above them; applying to a mediator before filing a lawsuit is a condition for filing suit (Law No. 6502, Art. 73/A).
Following your approval, the version of this Agreement generated specifically for this order is sent to your registered email address by email, which constitutes a durable medium. The Buyer may at any time access past versions of this Agreement from the Profile › My Consents screen, and the Seller will provide a further copy of the Agreement upon request.
The price above is valid at the moment you confirm this order; if you leave the page before payment is completed, it may be recalculated.
I accept that I have read and confirmed this Pre-Contractual Information Form and Distance Sales Agreement electronically. I know that when I press the payment button, I will have placed an order that creates a payment obligation.
